What is MEES?

The Minimum Energy Efficiency Standards (MEES) regime, set out in the Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015 (SI 2015/962), prohibits landlords from letting commercial property below a minimum EPC band. Since 1 April 2018 the minimum has applied to new lettings, and since 1 April 2023 it has applied to all existing lettings - that minimum is currently Band E.

A Band C 2028 minimum is proposed under the government's Non-Domestic Private Rented Sector consultation. It is not yet enacted in legislation and remains subject to legislative confirmation. We surface it as a forward-looking risk indicator only - not as current law.

How is the fine exposure calculated?

Per regulation 39 of SI 2015/962: a short breach (under 3 months) = 10% of the rateable value, minimum £5,000, maximum £50,000. A long breach (3 months or more) = 20% of the rateable value, minimum £10,000, maximum £150,000. The £150,000 cap is the regulatory ceiling - there is no flat-rate £30,000 alternative.

We look up your properties via the Open Data Communities EPC API maintained by the Ministry of Housing, Communities and Local Government (MHCLG, now DLUHC). If a property has no on-record EPC we flag it as unknown rather than guess.
